Harvard Law Review Forum, Commentary on Zittrain

So in the meantime I’m going to paste the piece below. It is a commentary on a paper by Jonathan Zittrain, called “The Generative Internet.”

Creative Commons v. Public Domain Dedication

I support creative commons, but lately I’ve been more into just throwing works into the public domain, through PD dedication. (CC of course, has a handy PD dedication tool).

Its simple and leaves behind no questions as to what anyone can do or not. They can do anything. No complex contract - copyright questions.

Of course there’s some chance someone will take something I wrote and do something I don’t like, but why not live dangerously like that

I’m in Paris — at a hotel is named “Tim Hotel.” Right next to this classic of university design:

The purpose of being in Paris is telecom — net neutrality and whether it has any relevance for europe.

The question, as I see it, is whether Europe goes sticks with unbundling rules, or starts using net neutrality rules instead.

In Geneva

Karim

Meanwhile, I’m in Geneva, visiting Karim, my best friend back in the Bay Area during my corporate days.

He’s pictured here on 7th St. near Ave. A (near Salon 7) after finishing a cross-country drive a few years ago.

Say what you like about Geneva, but it has its moments — like enjoying pastisse amongst the baths on the shore of the lake last night, as Karim says “where the hippies hang out”

And, for for airport obsessives like myself, it has the best airport access in the world! About 5mins from downtown via trains that go constantly. Geneva and Zurich set the world standard for airport access.

New Slate Series

I have started work on a new Slate series — “Lawbreaking in America.”

Dahlia Lithwick who I LOVE working with will be the editor.

The idea of the series is to take a snapshot of how Americans relate to their laws, right now.  The first two in the series are on:
1. Pornography

2. Drug laws

Copyright’s Authorship Policy

Meanwhile, I’ve also posted a draft of a new paper, “Copyright’s Authorship Policy,” on SSRN.

The idea of the paper is a defense of authorial copyright — the theory being that authorial ownership can seed new means of producing information that challenge existing industry structures.
